What Cumberland County Civil Court Records Contain
Civil court records in Cumberland County include the basic case information: the case number, the names of all parties, the civil case type, the date filed, and the judge assigned. The docket then records every event in the case. Each entry is dated and describes what happened. Filings, hearings, rulings, and court orders are all logged in order, creating a complete timeline from the case's first day to its final resolution.
The physical case file at the courthouse holds the actual documents. The complaint or petition that started the case is there. Answers, counterclaims, motions, court orders, and the final judgment are part of the record. Certified copies of judgments are the most commonly requested item. These copies are often needed to enforce a money judgment, record a lien against property, or satisfy a legal requirement in another proceeding. Exhibits submitted during hearings may also be stored with the file.
Some records are not open to the public. Juvenile cases are sealed by law. Adoption records are closed. Records sealed by court order are off limits. Sensitive personal data, including Social Security numbers and financial account numbers, is redacted from copies given to the public. For standard civil matters, including small claims, contract disputes, and debt collection, the records are public under 705 ILCS 105/16(6).
Electronic Filing in Cumberland County
Civil case filings in Cumberland County must go through eFileIL, the Illinois mandatory statewide eFiling system. This applies to new cases and all documents filed after the case is open. The system is available 24 hours a day.
To use eFileIL, register an account and submit documents through an approved Electronic Filing Service Provider, or EFSP. The EFSP sends your filing to the court. Once the clerk accepts the submission, you receive a confirmation with a timestamp. EFSP providers charge service fees on top of the standard court filing fees.
Certain groups are exempt from mandatory eFiling. Persons in prison or jail do not have to use the system. Will filings are exempt. Juvenile cases, adoptions, and filings by people whose disabilities prevent electronic use are also exempt. Good-cause exemptions may also be granted by the court. Approved forms for civil cases are available at illinoiscourts.gov/documents-and-forms/approved-forms/.
