What Cass County Civil Court Records Contain
Civil court records in Cass County begin with the core case details: the case number, the names of all parties, the civil case type, the filing date, and the name of the judge assigned. The docket then records every action taken in the case. Filings, hearings, motions, rulings, and orders are all logged with dates and descriptions. The docket covers the entire case from start to final resolution.
The physical case file at the courthouse holds the actual documents. The complaint or petition that started the case is in there. So are any answers or counterclaims, motions, court orders, and the final judgment. Certified copies of judgments are frequently needed to enforce a court ruling, record a lien against property, or satisfy a legal requirement in another proceeding. Exhibits submitted during hearings may also be part of the file.
Certain records are not open to the public. Juvenile cases and adoption records are sealed. Records sealed by court order are off limits. Sensitive personal data, like Social Security numbers and financial account numbers, is redacted from copies given to the public. Standard civil matters, including small claims, debt collection, and contract disputes, are public records under 705 ILCS 105/16(6), which requires court records be open during office hours.
Electronic Filing in Cass County
Civil case filings in Cass County must go through eFileIL, the Illinois mandatory statewide eFiling system. This applies to new case filings and to all documents filed after the case is open. The system is available 24 hours a day, every day.
To file, register an account with eFileIL and use an approved Electronic Filing Service Provider, or EFSP. The EFSP submits your documents to the court. Once the clerk accepts the filing, you receive a confirmation with a timestamp. EFSP providers charge their own service fees on top of court filing fees.
Exemptions apply to certain filers. Persons in prison or jail do not have to eFile. Will filings are exempt. Juvenile cases and adoptions are exempt. People with disabilities that prevent electronic use can request accommodation. The court may also grant a good-cause exemption. Approved court forms are available at illinoiscourts.gov/documents-and-forms/approved-forms/.
